In this writ petition, the petitioner-plaintiff has sought the following reliefs:

“(a) Issue a writ in the nature of Certiorari in quashing the order passed on 16.02.2026 adjourning the case OS 175/2021 to 27.04.2026 and produced at ANNEXURE D

¶26

(b) Issue a writ of mandamus directing the trial court to dispose of the matter in O.S 175/2021 on the file of Civil Judge J.M.F.C Nagamangala within six months from today Produced at ANNEXURE-D;

¶27

(c) Be pleased to grant such other relief or relief's as this Hon'ble Court may deem fit in the facts and circumstances of the case.

(d) Direct respondents to pay costs of the writ petition.”

For the sake of convenience, the parties herein are referred to as per their ranking before the Civil Judge and JMFC, Nagamangala (hereinafter referred to as ‘Trial Court’ for short) in Original Suit.

The plaintiff filed a suit in O.S.No.175/2021 before

the Trial Court seeking relief of Injunction. After issuance of suit summons, the defendant appeared and filed written statement. On the basis of the pleadings of the parties, the Trial Court has framed issues and the matter is set

down for recording the evidence of the parties. The evidence of the plaintiff has been completed. The suit is of the year 2021, and even after a lapse of four years, it has not been disposed of. Therefore, the present writ petition is filed seeking early disposal of the suit.

Having regard to the facts and circumstances of the case, and without expressing any opinion on the merits of the matter, this Court deems it appropriate to dispose of the writ petition with a direction to the Trial Court to dispose of the suit as expeditiously as possible.

Accordingly, the following order is passed:
