The petitioner is before the Court seeking the following

prayer:

a. Issue writ of mandamus or order directing the respondent to pay the entire arrears of maintenance to the petitioner in Crl.Misc.No.69/2024 filed under section 31 of Protection of Women From Domestic Violence Act 2005 R/w 128 of Cr.P.C on the file of Metropolitan Magistrate Traffic Court - V, Bengaluru in the interest of justice;

b. Writ in the nature of mandamus or order or direction directing the Trial Court to dispose of the petition filed under section 12 of DV Act in Crl. Misc.No.05/2023 on the file of Metropolitan Magistrate Traffic Court - V, Bengaluru within three months from today in the interest of justice and equity.

c. Pass any other order or orders as this Hon’ble Court deems fit and proper under the circumstances of this case, in the interest of justice and equity.”

2. The petitioner is the wife, the first respondent, the husband. The dispute between the two has led the wife before the concerned Court invoking Section 12 of the Domestic Violence in Crl.Misc.No.5/2023. The order of maintenance granted by the concerned Court were called in question before

the appellate Court and the matter is remitted back to the

concerned Court for reconsideration. The issue is of the year 2023.

3. In that light, the concerned Court shall conclude the proceedings in accordance with law within an outer limit of four months from the date of receipt of a copy of the order.

4. It is needless to observe that the parties to the lis would cooperate for such conclusion, failing which, the concerned Court is at liberty to pass necessary orders in accordance with law.

5. With the aforesaid direction, the writ petition stands disposed.
