Land Acquisition / Compensation Disbursal — Writ of mandamus under Article 226 (W.P. No. 109411 of 2025 (LA-RES)) by an agriculturist landowner of Hireadhapur village, Ilkal taluk, Bagalkot district, arising out of the Panaji-Hyderabad road widening acquisition: although compensation stood determined by an award dated 16.06.2023 and a supplementary award dated 08.07.2025 (Annexure-D), and the petitioner had made repeated representations on 06.09.2022, 02.03.2023 and 07.12.2023 (Annexures-E, E1 and E2), the amount had not been disbursed. Counsel for respondents 2 and 3 undertook that the representations would be considered in accordance with law within a reasonable time. ORAL ORDER

The petitioner has approached this Court seeking a writ of mandamus directing respondent No.2 to consider the representations submitted by the petitioner dated 06.09.2022, 02.03.2023 and 07.12.2023 (Annexures-E, E1 and E2) and to disburse the compensation amount in terms of the award passed in respect of the petitioner’s land.

Learned counsel for the petitioner submits that an award was passed on 16.06.2023, followed by a supplementary award dated 08.07.2025. Despite the determination of compensation under the award and the supplementary award, the compensation has not been disbursed to the petitioner till date. It is submitted that, despite repeated representations by

the petitioner, the same have not been considered, compelling the petitioner to approach this Court.

Per contra , learned counsel appearing for respondent Nos.2 and 3 submits that the representations submitted by the petitioner would be considered in accordance with law within a reasonable time.

Having regard to the submissions made and considering the grievance of the petitioner being nonconsideration of the representations despite the award and supplementary award being attained finality, this Court is of the opinion that the ends of justice would be met by issuing appropriate directions to the competent authority.

Accordingly, this Court pass the following:

ORDER

i. The writ petition is allowed .
