The petitioner, a Senior Labour Inspector is before this Court aggrieved by the interim order dated 01.04.2026 in Application No.2121/2026, whereunder the order of transfer of the petitioner and respondent No.3 is stayed by the Tribunal.

Heard Sri. M.Madhusudan, learned counsel for the petitioner and Sri. B.Ravindranath, learned Additional Government Advocate for respondent Nos.1 and 2 as well as Sri. M.K.Prithveesh, learned counsel for the

caveator/respondent No.3.

It is stated that the petitioner and respondent No.3 are working in the cadre of Senior Labour Inspector and under office order dated 31.03.2026, the petitioner is transferred from Somawarapete Circle, Somawarapete in place of respondent No.3 and respondent No.3 is posted to 4^th Circle, Bengaluru.

Learned counsel for the petitioner would submit that respondent No.3 herein is only holder of the post of Senior

Labour Inspector under Rule-32 of KCSR and he has to make way to the regular holder of the post. Learned counsel further submits that the Tribunal without appreciating the said contention and without taking note of the fact that this petitioner had already been relieved at Somawarapete Circle, Somawarapete, granted stay of impugned order of transfer.

On hearing the learned counsels for the parties and on perusal of the entire writ petition papers, we decline to interfere with the interim order passed by the Tribunal at this stage. The contentions raised by the petitioner are to be considered by the Tribunal at the time of final disposal. The Tribunal having found prima-facie case has granted interim order. The observations made in the impugned order shall not influence the Tribunal while disposing of the main petition.
