This Court vide order dated 11.11.2025 had directed respondent No.2/Corporation to pay the gratuity amount payable to the petitioners by 08.12.2025, failing which, the respondent No.2/Corporation was required to pay cost of Rs.25,000/-.

On 08.12.2025, the compliance was not reported. The matter was adjourned to 15.12.2025. On that day, again compliance was not reported. The Court ordered that by next date i.e. by 06.01.2026, if the gratuity amount is not paid in addition to Rs.25,000/cost ordered, the respondent No.2/Corporation will have to pay another Rs.15,000/- as additional cost.

It is submitted that the payment is made on 05.01.2026. Thus, the compliance is made. However, it is submitted that the cost of Rs.25,000/- as ordered is not paid.

Learned counsel for the respondent No.2/Corporation submits that the default is not intentional and costs may kindly be recalled.

Considering that the gratuity amount is paid, the cost ordered on 11.11.2025 is recalled. Since the payment is made, nothing survives for consideration.
