The petitioner is the owner of the land measuring 13 guntas in Survey No.32 of Devanachikkanahalli Village, Begur Hobli, Bengaluru South Taluk.

The land acquisition proceedings for acquiring a large extent of land, including the commercial land got completed by final notification on 03.11.1990. The said land was for the purpose of forming the BTM IV Stage Layout. The petitioner was allotted developed land to an extent of 939.28 square metres and he was directed to deposit Rs. 53,59,363/- at the rate of Rs.18,084/- per square metre as development charges.

The petitioner filed a writ petition No.34932/2016 submitting that the price fixed by the respondent, Bengaluru Development Authority (for short 8BDA) in the allotment letter dated 25.01.2016 was at the rate

of Rs.18,084/- per square metre which should be reworked taking note of the directions in W.P No.18025/2010 and the price should be charged at Rs.1,590/- per square meter. The petitioner has filed a representation to that effect on 14.03.2016. The learned Single Judge, having considered the order passed in the W.P No.18025/2010 directed the BDA to consider the representation of the petitioner dated 14.03.2016, and if the price is fixed at Rs.1,590/-

per square metre, the BDA should refund the excess amount after collecting the development charges at Rs.1,590/- per square metre. The learned Single Judge had kept open all contentions of the parties. It was further directed that the said direction to be complied within the period of two(2) months.

We do not see any reason to interfere with the aforesaid direction. We, therefore, dismiss this writ appeal. However, we grant one month further time to the BDA to decide the representation of the
