THIS RPFC IS FILED UNDER SECTION 19(4) OF THE FAMILY COURTS ACT., PRAYING TO ALLOW THE REVISION PETITION FILED BY THE PETITIONER BY SETTING ASIDE THE ORDER DATED 22.08.2022 PASSED IN CRL.MISC.NO.50/2019 ON THE FILE OF THE PRINCIPAL JUDGE, FAMILY COURT, SHIVAMOGGA AND ETC

THIS PETITION COMING ON FOR FINAL HEARING THIS DAY, ORDER WAS MADE THEREIN AS UNDER:

ORAL ORDER

Learned counsel for the petitioner is present. Service

of notice to the respondent is held sufficient vide order dated 18.07.2025.

This Court vide order dated 29.11.2022 has

granted interim stay as under:-

“ ORDER ON I.A.NO.1/2022

The case of the petitioner is that respondent No.1 is his wife and admittedly, she has inherited certain rights in the property belonging to her father and there is a rental income of around Rs.3,00,000/- (Rupees Three Lakhs only) from the said property and she has share in it.

Based on the aforementioned submission, there shall be stay of the execution of the impugned order dated 22.08.2022 passed by the Court of Principal Judge,

Family Court, Shivamogga in Crl.Misc.No.50/2019, subject to the petitioner paying the maintenance amount awarded in favour of respondent No.2 in full and 50% of the amount awarded in favour of respondent No.1, till the next date of hearing.

Accordingly, I.A.No.1/2022 is disposed of.”

Thereafter, the stay granted by this Court is also not extended. Further on 24.03.2026, the petitioner is directed to file the proof for compliance of order dated 29.11.2022, failing which, the interim order stands vacated. It is observed that, petitioner has not filed any proof for payment details with regard to compliance of interim order dated 29.11.2022.

Further, learned counsel for the petitioner submits

that he has sent legal notice to the petitioner and it has returned with an endorsement ‘unclaimed’. Hence, learned counsel for the petitioner intends to file memo for retirement and sought time.

It appears that though legal notice is sent to the petitioner, same is returned as ‘unclaimed’. In view of the

same, it appears that the petitioner is not interested in taking steps with regard to compliance of the interim order dated 29.11.2022. In view of the same, nothing survives in the petition. Accordingly, the RPFC is hereby

dismissed for non-compliance of the interim order.
