The present appeals filed by the husband-appellant against the order dated 20.09.2025 passed by the I Additional Principal Judge, Family Court, Dakshina Kannada, Mangaluru in MC.No.36/2024, filed by the respondent-wife seeking a decree of divorce dissolving her marriage with the appellant which was solemnized on 08.02.2015.

2. The learned Family Court vide impugned judgment and decree has dissolved the marriage between the appellant and respondent under Section 13(1)(i-a) (i-b) of the Hindu Marriage Act, 1955 and granted permanent alimony of Rs.25,00,000/- (Rupees Twenty Five Lakhs only) to the respondent-wife.

3. During the pendency of these appeals, the parties were referred to the Karnataka Mediation Centre, Bengaluru and the parties have settled their dispute amicably. Accordingly, the parties have filed a

Memorandum of Settlement under Section 8 9 of CPC read with Rules 24 and 25 of the Karnataka Civil Procedure (Mediation) Rules, 2005.

4. The parties have affixed their signatures on

each page of the Memorandum of Settlement and the last page has been duly signed by the Mediator. The respondent-wife has joined the proceedings through online, while the appellant-husband is present in person and the parties have duly identified by their respective counsels.

5. The parties state that they have entered into settlement out of their free will, without any force and undue influence and they shall abide by the terms and conditions of compromise.

6. The terms of settlement reads as under:

I. In the above appeal the appellant is questioning the impugned judgment and decree dated 20.09.2025 passed in M.C. No.36/2024 on the file of the Court of I Additional Principal Judge, Family Court, D.K., Mangaluru, thereby allowing the petition for divorce under section 13(1)(i-a) and 13(1)(i-b) of the Hindu Marriage Act, 1955 filed by Respondent against the appellant and further dismissing the counter claim Petition under Section 9 of Hindu Marriage Act, 1955 for Restitution of conjugal rights filed by the Appellant.

II. The aforesaid matter was referred to the mediation, during the course of mediation the Appellant and the Respondent along with their respective counsel were present, identified each other and they have resolved their dispute and have agreed for the following terms and conditions.

1.The Appellant and the Respondent are legally wedded husband and wife, their marriage was solemnized on 08.02.2015 at Kateelu Sri Durga Parameshwari Temple, Kateelu, D.K.Mangaluru. In their wedlock they have one daughter namely Prathyusha born on 02.02.2016. She is in the care and custody of the Respondent/Mother and shall continue to be so in future for which the Appellant/Father has no objection.

2.In view of this settlement arrived at, the parties hereby agreed to dissolve their aforesaid marriage and to modify judgment and decree passed in M.C.No.36/2024 on the file of the Court of I Additional Principal Judge, Family Court, D.K., Mangaluru.

3.The Appellant has agreed to pay a sum of Rs.6,75,000/-(Rupees Six Lakhs Seventy Five Thousand Only) to the Respondent towards the welfare of the child. The said amount will be paid by the Appellant to the Respondent by way of RTGS to the Respondent's account on or before 20.03.2026 which is mentioned herein below for which the Respondent has agreed:

4. The Respondent has agreed to bear entire expenses of their daughter such as maintenance, education, medical and all other incidental expenses.

5. The Appellant has visitation right over the minor child Prathyusha. He is at liberty to visit the minor child Prathyusha once in a month either on Government holiday or weekend at mutual convenient place at Mall, Park or temple at Mangalore with prior intimation to the Respondent/Mother without disturbing the education and other curricular activities of the minor child.

6. Both the parties state that they have no claims in respect of maintenance/permanent alimony against each other as both of them are capable of maintaining themselves independently.

7. Both parties state that they have no claims over the movable/immovable properties against each other either existing or to be acquired in future.

8. Both the parties state that they have already exchanged their valuable articles and other personal belongings as such they have no claims in this regard.

9. Both the parties agreed that they have no claims against each other of whatsoever nature.

10. Both the parties state that there are no other pending cases against each other in any Court/Authority.

11. Both the parties undertakes to withdraw all the allegations made against each other.

12. Both the parties admit and agree that there is no collusion or force, fraud or any undue influence in filing the above petition and entering into this compromise in the aforesaid manner.

13. Both the parties state that they shall not interfere with the lives of each other and their family members in future.

III. In view of the aforesaid agreement entered into between the parties, the parties pray that this Hon'ble High Court be pleased to pass appropriate orders in terms of this settlement agreement.

IV. Parties shall appear before the Hon'ble High Court of Karnataka for passing necessary orders in terms of the agreement whenever the matter is listed before the Hon'ble Court."
