The appeal was filed by the petitioner/husband under Section 19(1) of the Family Court Act, 1984 seeking to challenge the judgment and decree dated 27.08.2018 passed in MC No.3783/2015 seeking a decree of divorce under Section 13(1)(i-a) of the Hindu Marriage Act, 1955.¹ By means of the impugned judgment and decree, the petition filed by the appellant was dismissed.

Today, a joint memo has been filed by the parties bearing their signatures as well as those of their advocates containing therein the terms of the settlement entered into between the parties. The parties who are present in the Court acknowledge their signatures and the fact that they have

entered into the aforesaid settlement presented by way of joint memo voluntarily and freely. The aforesaid joint memo is supported by a joint affidavit of the parties.

Additionally, an application has been filed today under Section 13-B of the H.M Act seeking dissolution of their marriage by decree of divorce by mutual consent. A reference has made to the terms of the joint memo entered into between the parties as aforesaid. The aforesaid application is supported by a joint affidavit of the parties.

The parties have also produced their Aadhar Cards and photo copies thereof, which have been self-attested by them and they are identified by their respective advocates.

The application-IA No.1/2026 under Section 13-B of the H.M. Act is therefore allowed and the marriage entered into between the parties at Dudor, Pali District, Rajasthan on 01.05.2006 is hereby dissolved and a decree of divorce shall issue.
