Contempt of Courts Act, 1971 - S. 15(1)(b) - Criminal Contempt - CRL.CCC No. 1 of 2017 (High Court of Karnataka, Division Bench of Anu Sivaraman and Venkatesh Naik T, JJ.; judgment delivered per Anu Sivaraman, J.) decided on 16 June 2026: The complainant alleged that the accused fabricated and forged a Sale Deed dated 19.02.2015 (Annexure-G), obtained a decree dated 03.10.2015 in S.C. No.1157/2015 (SCCH Bengaluru) by falsely depicting Accused No.6 as tenant, obtained a Compromise Decree dated 21.02.2016 in S.C. No.234/2016 by describing Accused No.8 as the complainant's GPA holder, and conspired to procure a delivery warrant in Ex. Petition No.517/2016 before SCCH No.17 while suppressing a pending enquiry in Ex.P.No.2303/2015 before SCCH No.25, thereby abusing the process of court and dispossessing the complainant. This Criminal Contempt of Court case is filed on the

following allegations:-

i. The Accused No.1 to 4 for Fabricating and forging the Sale Deed dated 19.02.2015 vide Annexure-G;

ii. The Accused No.1, 5 and 6 for obtaining the Decree dated 03.10.2015 vide Annexure-L by depicting the Accused No.6 as Tenant and presenting the compromise petition as reflected in the order sheet vide Annexure-K in S.C. No.1157/2015 before the Small causes Court at Bengaluru;

iii. The accused No.1,7 and 8 for committing the offence of perjury and the offence of forgery for the purpose of cheating the complaint, describing the Accused No.8 as GPA holder of the complainant and her sister in the cause title of the Plaint in S.C. No.234/2016 vide Annexure-R and obtaining a Compromise Decree dated 21.02.2016 vide Annexure-S;

iv. The Accused No.1 to 9 for conspiring together and obtaining a delivery warrant in Ex. Petition No.517/2016 vide Annexure-T before SCCH No.17, suppressing the pendency of enquiry proceeding before SCCH No.25 in Ex.P.No.2303/2015 vide Annexure-M thereby abusing the process of court and dispossessing the Complainant from the suit schedule property in a

fraudulent manner and for bringing the administration of justice to disrepute;

We have heard Sri. Thejesh P., learned High Court Government Pleader appearing for the complainant as well as Sri. H. Mallan Goud, learned counsel appearing for accused No.1 to 3, Sri. A.N. Radha Krishna, learned counsel appearing for accused No.5, Sri. H.R. Narayana Swamy, learned counsel appearing for accused No.7 and Sri. Jeevan Neeralagi, learned counsel appearing for accused No.8.

We also notice that the matter had been listed for

arguments. However, accused No.1, 2, 5, 7 and 8 who are present before the Court have filed unconditional apology before this Court.

Learned counsel appearing for the accused submits that the apology is unconditional and that the parties will not commit any further contempt of the orders or authority of law. It is stated that the apology is tendered on understanding the implications of their acts and that such acts will not be repeated.

opinion that the unconditional apology tendered by the accused can be accepted. Accordingly, the unconditional apology is accepted.
