The petitioners-accused Nos. 1 to 5 are before the court calling in question Crime in Crime No. 328/2023 registered for offences punishable under Sections 143, 147, 148, 149, 384, 504 & 506 of IPC and under Section 24 of Maintenance & Welfare of Parents & Senior Citizens Act, 2007.

Heard Sri Parashuram R. Hattarakihal, learned counsel appearing for the petitioners and Sri K. Nageshwarappa, learned High Court Government Pleader appearing for respondent No.1, and Smt Apoorva N., learned counsel appearing for respondents No.2 and 3.

Facts in brief germane are as follows:

It transpires that the first petitioner is married to one Upendra Kumar on 27.11.2020. Relationship between the two turning sour leads the first petitioner to register a crime against the husband and in-laws in Crime No.82/2023. Immediately on coming to know of the registration of the crime, the respondents registered a crime against these petitioners. The registration of the crime has driven the petitioners to this court in the subject petition.

The learned counsel appearing for the petitioners submits that the subject crime is registered only as a counter blast to what the petitioners registered against the husband and the in-laws which had become a crime in Crime No. 82/2023, and would submit that the crime being registered as a counter blast must not be permitted to be continued in the light of settled principle of law.

The learned counsel for the respondent-complainant would however refute the submission in contending that investigation must be permitted to be continued as the petitioners have kept the car belonging to the complainant. Therefore, the crime has sprung.

A perusal at the complaint would not indicate

where from the offence under Section 384 of IPC has sprung. Section 384 of IPC deals with extortion. The ingredients of

extortion are found in Section 383 of the IPC. None of the ingredients that are necessary to be present in a case of extortion is even present in its semblance in the case at hand. The allegations are bald. The only instance is the car allegedly belonging to the respondent being kept with the petitioners. Therefore, the issue has sprung. A pure family dispute between the parties is projected to become a crime of extortion is itself a reason for interference and quashment of the proceedings.
