Accused no.5 in Crime No.116/2026 registered by Srirangapatna Police Station, Mandya District, for the offences punishable under Sections 189(2), 191(2), 352, 115(2), 118(1), 109(1), 351(2), 190 of BNS, 2023, is before this Court in this petition filed under Section 482 of BNSS, 2023, seeking anticipatory bail.

Heard the learned Counsel for the parties.

FIR in Crime No.116/2026 was registered by Srirangapatna Police Station, Mandya District, for the aforesaid offences against Rakesh and others based on the first information dated 13.05.2026 received from Kumar.G.C., who is one of the injured victim in the present case. Apprehending arrest in the said case, petitioner had filed Crl. Misc. No.5173/2026 before the jurisdictional Sessions Court, which was rejected on 10.06.2026. Therefore, he is before this Court.

Perusal of the material on record would go to show that

the injured victims in the present case are employed in a company known as Coron Factory India Pvt. Ltd. It appears that accused nos.1 & 2 were also working in the said company and they were dismissed from service on the ground of misconduct.

In the first information, it is stated that accused nos.1 & 2 had therefore developed ill-will against the injured victim - Manjunath and on the alleged date of incident, when the victims were traveling in the motor bike, accused persons summoned them and after quarreling with them, allegedly assaulted the victims.

Perusal of the first information would go to show that the allegation of assaulting the injured victim - Manjunath on his head with a beer bottle is found as against accused no.3 - Harshith. The allegation as against the other accused persons is that they had assaulted the victims with their hands and legs. Undisputedly, petitioner has no other criminal antecedents. Under the circumstances, I am of the opinion that petitioner's

prayer for grant of anticipatory bail is required to be answered affirmatively. Accordingly, the following order:

The petition is allowed. The respondent - Police or any other police in the State of Karnataka are directed to release the petitioner in the event of his arrest in Crime No.116/2026 registered by Srirangapatna Police Station, Mandya District, for the offences punishable under Sections 189(2), 191(2), 352, 115(2), 118(1), 109(1), 351(2), 190 of BNS, 2023, subject to the following conditions:

The Petitioner shall appear before the Investigating Officer within 15 days from the date of receipt of the copy of this order and shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum to the satisfaction of the investigating officer.

Petitioner shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons.

¶44

Petitioner shall not tamper with the prosecution witness and he shall co-operate with the police for investigation and appear before them whenever called upon.
