Heard the learned Counsel for the parties.

Learned Counsel for the petitioners submits that accused no.1/petitioner no.1 has been now acquitted by the Trial Court in C.C.No.4354/2023 which arises out of Crime No.7/2023 registered by Mysuru Women Police Station, for the aforesaid offences. She submits that respondent no.2 has turned hostile to the case of the prosecution and she has submitted before the Trial Court in C.C.No.4354/2023, that the dispute between her husband and herself has been amicably settled. She has made available the copy of the judgment and order passed in C.C.No.4354/2023 dated 13.02.2025.

Learned HCGP who has opposed the petition does not dispute the submission made by the learned Counsel for the petitioners.

Learned Counsel for respondent no.2 is absent.

registered by Mysuru Women Police Station, for the aforesaid offences, would go to show that respondent no.2 was examined in the said case as PW-1 and she as completely turned hostile to the case of the prosecution. She has denied the allegations made by her against her husband who is arrayed as accused no.1 in the present case and also has submitted before the Trial Court that the dispute between her and her husband has been amicably settled.

The proceedings in so far as accused nos.2 & 3 are concerned, has been stayed by this Hon'ble Court vide order dated 08.09.2023, and therefore, it appears that trial was held in the present case only as against accused no.1.

In view of the aforesaid, I am of the opinion that continuation of trial as against accused nos.2 & 3 who are the in-laws of respondent no.2, would be a futile exercise. Hence, the following order:

Petition is allowed in part. Petition in so far as accused no.1/petitioner no.1 is dismissed as having rendered infructuous.

Civil Judge & JMFC, Mysuru, arising out of Crime No.7/2023 registered by Mysuru Women Police Station, Mysuru, for the offences punishable under Sections 498A, 504, 114, 34 IPC and Sections 3 & 4 of Dowry Prohibition Act, 1961, is quashed as against accused nos.2 & 3/petitioner nos.2 & 3 herein.
