Accused no.1 in Crime No.64/2026 registered by Pavagada Police Station, Tumakuru District, for the offences punishable under Sections 85, 108, 3(5) of BNS, 2023, is before this Court in this petition filed under Section 483 of BNSS, 2023, seeking regular bail.

Heard the learned Counsel for the parties.

FIR in Crime No.64/2026 was registered by Pavagada Police Station, Tumakuru District, for the aforesaid offences against petitioner and others based on the first information dated 06.03.2026 received from Krishnappa - father of deceased Meghana. In the said case, petitioner herein was arrested on 06.03.2026 and remanded to judicial custody. After completing investigation, charge sheet has been filed against three persons and petitioner is arrayed as accused no.1 in the charge sheet. His bail application filed before the jurisdictional

Sessions Court in Crl. Misc. No.5094/2026 was rejected on 26.03.2026. Therefore, petitioner is before this Court.

Petitioner is the husband of deceased Meghana. It

¶29

appears that the marriage of the petitioner with Meghana was performed in the year 2018 and from the wedlock, they have two minor children. In the first information as well as in the charge sheet, it is alleged that Meghana was not properly taken care of in her matrimonial home and she was being physically and mentally tortured. Meghana, therefore, started working in a road side hotel and accused persons allegedly abused her for the said reason. Meghana had committed suicide on 05.03.2026 by hanging herself to a ceiling fan in her room. Accused nos.2 & 3 are the mother and brother of the petitioner herein. They have been enlarged on bail. Petitioner who has no criminal antecedents is in custody for the last more than three months. Investigation of the case is completed and charge

sheet has been filed. The charge sheeted offences are not punishable with death or life imprisonment. Under the circumstances, I am of the opinion that petitioner's prayer for

grant of regular bail is required to be answered affirmatively. Accordingly, the following order:

The petition is allowed. The petitioner is directed to be enlarged on bail in Crime No.64/2026 registered by Pavagada Police Station, Tumakuru District, for the offences punishable under Sections 85, 108, 3(5) of BNS, 2023, subject to the following conditions:

a) Petitioner shall execute personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court;

¶37

b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons;

¶38

c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses;

¶39

d) The petitioner shall not involve in similar offences in future;

¶40

e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said
