The petitioner is before this Court calling in question proceedings in Crime No.56/2024, registered for the offences punishable under Sections 506, 341, 504, 323 and 354 of Indian Penal Code.

Heard Sri.Nishit Kumar Shetty, learned counsel appearing for the petitioner, Sri.Channappa Erappa, learned HCGP appearing for respondent No.1, Sri.Taji George, learned counsel appearing for respondent No.2 and have perused the material on record.

During the pendency of the proceedings, the parties

to the lis have settled the dispute among themselves and have filed a compounding application along with the affidavit of the petitioner. The Compounding Application filed by the counsel for petitioner and respondent No.2 reads as follows:

“APPLICATION UNDER SECTION 528 READ WITH SECTION 359(2) OF BHARATIYA NAGARIK SURAKSHA SANHITA/482 READ WITH SECTION 320(2) OF CRIMINAL PROCEDURE CODE

The Petitioner and Respondent No.2 respectfully submits as follows:

1. It is submitted that in the above criminal petition, the petitioner is seeking for quashing the FIR against the petitioner in Crime.No.56/2024 of Vivek Nagar Police Station, pending on the file of 29th A.C.M.М., Mayohall, Bangalore for the offences punishable under section 506, 341, 504, 323, 354 Of IPC.

2. It is submitted in the above case the respondent no.2/complainant filed complainant against the Petitioner and the same is registered in Crime No.56/2024 of Vivek Nagar Police Station, for the offences punishable under section 506, 341, 504, 323, 354 Of IPC. The respondent no.2 herein is the complainant, aggrieved person and competent to compound the offences alleged.

It is submitted that, the petitioner is the owner of the house where 2nd respondent is staying on rent and the dispute between them are settled amicably within themselves with the intervention of well-wishers and the Respondent No.2 has no objection to quash the proceedings against the Petitioner. In view of the compromise arrived between the parties, respondent no. 2 has no

objection to quash the entire proceeding against the petitioner for the aforesaid offences.

4. It is submitted that offence under Section 506, 341, 504, 323, OF IPC are compoundable in nature. Though the offence under section 354, is noncompoundable in nature but respondent No.2 is not having any objection for quashing the entire proceedings against the Petitioner since the dispute between them are settled amicably within themselves with the intervention of well-wishers. In view of the facts and circumstances of the case, it is just and proper to permit the parties to compound the offence alleged against the Petitioner and quash the FIR against the petitioner in Crime.No.56/2024 of Vivek Nagar Police Station, pending on the file of 29th A.C.M.M., Mayohall, Bangalore for the offences punishable under section 506, 341, 504, 323, 354 OF IPC Otherwise the Petitioner will be put to irreparable injury and hardship.

Wherefore, it is prayed that this Hon'ble Court be pleased to permit the parties to compound the offences against the Petitioner and quash the FIR against the petitioner in Crime. No.56/2024 of Vivek Nagar Police Station, pending on the file of 29th A.C.M.M., Mayohall, Bangalore for the offences punishable under section 506, 341, 504, 323, 354 Of IPC, in the interest of justice.”
