Heard Sri. Sudharshan L., learned counsel appearing for

the petitioner, Sri. K. Nageshwarappa, learned HCGP appearing for respondent No.1, Sri. Narayanaswamy H., learned counsel appearing for respondent No.2 and have perused the material on record.

During the pendency of the proceedings, the parties to the lis have settled the dispute among themselves and have filed a compounding application along with affidavits.

The compounding application reads as follows:

" APPLICATION u/s 320(2) r/w 482 of Cr.P.C.

That the petitioner is arrayed as accused no.1 for the offences punishable u/s 504, 323, 325 r/w 34 of IPC and section 3(1)(r)(s), 3(2)(v-a) of SC/ST (Prevention of Atrocities Act) on the file of Hunsur Town police station in crime no. 86/2024 and in Spl.Case no.274/2024 which is pending on the file of Learned VI Addl.District and Sessions Judge at Mysuru.

That being aggrieved by the proceedings in Spl case no.274/2024 on the file of Learned VI Addl. District and Sessions Judge at Mysuru, the petitioner has preferred the above criminal petition by invoking sec. 482 of Cr.P.C. for quashing of the proceedings against him.

That during the pendency of the above matter before this Hon'ble court, that upon intervention of well-wishers and friends, the dispute between the petitioner and the

respondents is amicably resolved with cordial terms. And therefore, the respondents have no objection to quash the proceedings against the petitioner by withdrawing the allegations levelled against him.

That the respondents are not interested in prosecuting the petitioner in view of the compromise with the petitioner and further has felt that continuation of criminal proceedings against the petitioner would not serve any fruitful purpose and it would only be an abuse of process of law.

That the settlement arrived between the petitioner and the respondents is out of free will, there is no coercion or force, fraud or any undue influence.

WHEREFORE, the petitioner and respondents most humbly pray that this Hon'ble court may be pleased to permit them to compound the above matter and to quash the proceedings in Spl.Case no. 274/2024 on the file of VI Addl. District and Sessions Judge at Mysuru for the offences punishable u/s 504, 323, 325 r/w 34 of IPC and section 3(1)(r)(s), 3(2)(v-a) of SC/ST (Prevention of Atrocities Act) in the interest of justice."

In the light of application for compounding being

filed along with the affidavits and offences not being against the State, I deem it appropriate to accept the compounding application and terminate the proceedings against the petitioner in the subject petition.
