Learned counsel for respondent submitted that one of main grounds urged in this petition was that petitioner along with his wife having filed insolvency case in IC no.8/2017 against 26 persons before LXVI Additional City Civil and Sessions Judge, Bangalore, including complainant herein even though he was a total stranger qua petitioners. It was submitted that proceedings in IC no.8/2017 had since been dismissed. Therefore, there would be no justification for continuation of above petition.

2. In order to provide opportunity, matter was adjourned. However, there is no representation on behalf of petitioner even today. This would indicate that petitioner is not diligent in pursuing petitions. Petitions are dismissed for non - prosecution .
