1. Petitioner, who is apprehending arrest in Crime No.49/2026 registered by Siddapura Police Station, Benglauru, for the offence punishable under Section 306 of BNS, 2023, is before this Court under Section 482 of BNSS, 2023, seeking anticipatory bail.

2. Heard the learned counsel for the parties.

FIR in Crime No.49/2026 was registered by Siddapura Police Station, Bengaluru, for the aforesaid offence against petitioner and others based on the first information dated 08.03.2026 received from Bhavana Bafna W/o Mehaksha. Apprehending arrest in the case, petitioner had filed Crl.Misc.No.2901/2026 before the jurisdictional Sessions Court which was rejected on 27.03.2026. Therefore, she is before this Court.

4. In the first information, which is submitted on 08.03.2026, it is stated that the first informant had gone to Dubai along with family members on 21.02.2026 and while leaving to Dubai, she had kept her gold chain, diamond finger

ring and other jewelleries inside a cupboard in her bedroom and had locked the same. On 27.02.2026, she had returned from Dubai and found that her cupboard was open and her jewelleries were missing. First information is thereafter, belatedly filed on 08.03.2026. During the course of investigation, petitioner, who is arraigned as accused No.1 in the first information had appeared before the police and her statement is also recorded on 10.03.2026. Therefore, it is apparent that petitioner, who is a married lady aged about 37 years, has cooperated with the police for the purpose of investigation. The alleged offence is triable by the Court of Magistrate and the petitioner has no other criminal antecedents. Under the circumstances, the prayer made by the petitioner for grant of anticipatory bail needs to be answered affirmatively. Accordingly, the following:5. The petition is allowed. The respondent - Police or any other police in the State of Karnataka are directed to release the petitioner in the event of his arrest in Crime No.49/2026 registered by Siddapura Police Station, Benglauru, for the offence punishable under Section 306 of BNS, 2023, s ubject to the following conditions:

The Petitioner shall appear before the Investigating Officer within 15 days from the date of receipt of the copy of this order and shall execute a personal bond for a sum of Rs.1,00,000/with two sureties for the likesum to the satisfaction of the investigating officer.

Petitioner shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons.

¶34

Petitioner shall not tamper with the prosecution witnesses and he shall co-operate with the police for investigation and appear before them whenever called upon.

¶35

The petitioner shall not involve in similar offences in future.
