The appellant has preferred this appeal against the order passed by the Special II Additional District and Sessions Judge, Chitradurga in Crime No.448/2025 dated 24.12.2025.

The brief facts leading to this appeal are that, on the basis of the complaint filed by victim, Hiriyur Rural Police have registered the case in Crime No.448/2025 against accused Nos.1 to 5 for the offences punishable under Sections 64(2)(m), 318(2), 49, 351(2), 3(5) of the Bharatiya Nyaya Sanhita, 2023 (for short 'BNS, 2023'); Sections 3 and 4 of the Dowry Prohibition Act, 1961 and Sections 3(1)(w)(i), 3(2)(V) of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989.

During the course of investigation, Investigating Officer has arrested the accused and produced before the Special Judge, he was remanded to the judicial custody and till this day the accused is in judicial custody. After

completion of investigation, the Investigating Officer has submitted the charge sheet against accused Nos.1 to 5 for the offences punishable under Sections 64(2)(m), 318(2), 49, 351(2), 3(5) of the Bharatiya Nyaya Sanhita, 2023 (for short 'BNS, 2023'); Sections 3 and 4 of the Dowry Prohibition Act, 1961 and Sections 3(1)(w)(i), 3(2)(V), 3(2)(v-a) of the Scheduled Castes and the Scheduled Tribes (Prevention Of Atrocities) Act, 1989.

The appellant/accused No.1 has filed application under Section 483 of BNSS, 2023 for grant of anticipatory bail. Same came to be rejected by the Trial Court. Being aggrieved by the rejection of the bail, the appellant/accused No.1 has preferred this appeal.

The learned counsel for the appellant/accused No.1 would submit that the alleged incident took place on 19.12.2024 as shown in the FIR. After lapse of nearly 1 year, the present complaint is filed. The appellant/accused No.1 has not committed the offence as alleged by the

prosecution. The entire dispute is predominantly matrimonial and civil in nature, arising out of a failed marriage proposal, financial disagreements and strained relationships between the families, which has been given a criminal colour. Since, the investigation is already completed, the accused is not required for custodial interrogation. Further, he would submit that the appellant/accused No.1 has already paid an amount of Rs.15,00,000/- to the complainant. On all these grounds, it is sought to allow this appeal.

Considering the inordinate delay in filing the complaint, nature and gravity of offences, previous antecedents of the appellant/accused No.1 and payment of

Rs.15,00,000/- to the complainant, it is just and proper to allow this appeal. Accordingly, I proceed to pass the following:

Appeal is allowed.

i. The impugned order passed by the Special II Additional District and Sessions Judge, Chitradurga in Crime No.448/2025 dated 24.12.2025 is set aside. Consequently application filed under Section 483 of BNSS, 2023 filed on behalf of appellant who is accused No.1, is allowed.

ii. The appellant shall be released on bail in the event of his arrest in Crime No.448/2025 of Hiriyur Rural Police on executing a self bond of Rs.1,00,000/- with one surety for the likesum, to the satisfaction of trial Court.

iii. Appellant shall not tamper or threaten the prosecution witness in any manner.
