ORAL JUDGMENT

The appellant who is accused No.2 in Special Case No.507/2023, had preferred this appeal against the order passed by the II Additional District & Sessions Judge and Special Judge, Bengaluru Rural District, Bengaluru in Crl.Misc.No.2000/2025 dated 13.11.2025.

It is submitted by the learned counsel for the appellant that the co-ordinate bench of this Court has granted bail to the present petitioner in Criminal Petition No.7370/2017 dated 23.11.2017 by imposing conditions. Since the appellant has violated the bail conditions, the NBW was issued against this appellant and he was arrested and produced under NBW on 05.05.2024 and he was remanded to judicial custody. Since the accused is in judicial custody even after lapse of one and half year, the

trial Court has not framed the charges against the accused and trial is not yet commenced. The appellant undertakes to abide by the conditions which may be imposed by this Court.

On perusal of the impugned order, the trial Court has observed that the appellant was arrested by the respondent police on 15.05.2024 and he is languishing in judicial custody. Prior to this, the appellant has obtained anticipatory bail by the co-ordinate bench of this Court in Criminal Petition No.7370/2017 dated 23.11.2017. Though the accused is in judicial custody for more than one and half years, the trial Court has not framed the charges against him.

Considering the facts and circumstances of this

case and keeping in mind Article 21 of the Constitution, it is just and proper to release the accused on bail with conditions. Accordingly, I proceed to pass the following:

i) The appeal is allowed .

¶38

ii) The order passed by the II Additional District & Sessions Judge & Special Judge, Bengaluru Rural District, Bengaluru in Crl.Misc. No.2000/2025 dated 13.11.2025 is set-aside . Consequently, the application filed under Section 439 of Cr.P.C. by the appellant is allowed .

iii) The appellant shall be released on bail on executing a self bond of Rs.1,00,000/- with two sureties for the like-sum to the satisfaction of the trial Court. Along with two sureties, the appellant shall deposit an amount of Rs.20,000/- cash security before the trial Court.
