This petition is filed by accused No.2 under Section

482 of BNSS praying to grant anticipatory bail in Crime No.621/2025 of Hebbagodi Police Station registered for offences punishable under Sections 121(1), 132, 352 read with Section 3(5) of BNS.

Heard learned counsel for the petitioner and

learned High Court Government Pleader for the respondent -State.

Learned counsel for petitioner would

contend that accused No.3 has been granted bail by the trial Court. He further submits that the allegation against this petitioner in the complaint is that he abused the

complainant in filthy words. There is no allegation of any assault by this petitioner. The petitioner is ready to cooperate with the police in the investigation and abide by any conditions to be imposed by this Court. Offences alleged against the petitioner are not punishable either with death or imprisonment for life. With this, he prays to allow the petition.

Pleader for the respondent -State would contend that the petitioner has been issued with notices twice. In spite of that, he has not appeared for investigation. The petitioner is required for interrogation. With these, he prays to reject the petition.

Having heard learned counsels, the Court

has perused FIR, complaint and other materials placed on record.

On receipt of the information from control room, that there are three persons who are demolishing

building, the petitioner who is police constable went to the spot and saw that three persons were demolishing building and he enquired and they abused him in filthy language and accused No.1 snatched his body worn camera and assaulted him with hammer on his leg and caused injury.

The allegation against this petitioner is abusing the complainant in filthy language. The petitioner has undertaken to co-operate with the police in the investigation. Offences alleged against the petitioner are not punishable either with death or imprisonment for life. There are no criminal antecedents of the petitioner. Considering the above aspects, the petitioner has made out case for grant of anticipatory bail with conditions.

ii) The petitioner is ordered to be released on bail in the event of his arrest in Crime No.

Hebbagodi Police Station subject to following conditions:

a) The petitioner –accused No.2 shall appear before the Investigating Officer within 10 days from this day and execute a bail bond for a sum of Rs.1,00,000/- with one surety for the like sum to the satisfaction of the Investigating Officer.

b) The petitioner –accused No.2 shall appear before the Investigating Officer whenever called for and cooperate with the investigation.

c) The petitioner –accused No.2 shall appear before the Investigating Officer between 10.00a.m., to 2.00p.m., on every Sunday for a period of one month or till filing of the final report whichever is earlier.
