This petition is filed by accused No. 5 under

Section 482 of BNSS praying to grant anticipatory bail in Crime No. 143/2025 of Madhugiri Police Station registered for offence punishable under Sections 11, 4, 8, 9 of Karnataka Prevention of Cow Slaughter and Cattle Prevention of Act, 2020, Sections 192(A), 177 of Indian Motor Vehicle Act, 1988, Section 11(1)(A) of Prevention of Cruelty to Animal Act, 1960, Section 56, 51, 57, 96, 97 and 98 of Transportation of Animal Act, 1978, Sections 3, 4, 1, 125(E) of Central Motor Vehicle Rules, 2015 and

Heard learned counsel for petitioner and

learned HCGP for respondent - State.

Learned counsel for petitioner would contend that accused Nos. 1, 3 and 4 have been granted bail by the trial Court and therefore petitioner is entitled for grant of anticipatory bail on the ground of parity. The allegation against the petitioner is that he loaded the cattle in the truck and it was carried by accused Nos. 1, 3 and 4 in the truck belonging to accused No. 2. Petitioner is not concerned with the alleged offence. Petitioner is ready to cooperate with the Investigating Officer in the investigation and abide by any conditions to be imposed by this Court. Offence alleged against the petitioner is not punishable either with death or imprisonment for life. There are no criminal antecedents of the petitioner. With this, he prayed to allow the petition.

Per contra learned HCGP would contend that

investigation is in progress. Petitioner is required for custodial interrogation. With this, he prayed to reject the petition.

Having heard learned counsel for the parties the

Court has perused the FIR, complaint and other materials placed on record.

¶39

The allegation against this petitioner- accused No. 5 as averred in the complaint is that he loaded the cattle in the truck of the ownership of accused No. 2 which was driven by accused No. 1 and accused Nos. 3 and 4 were inmates of the truck as helpers/cleaners. Said cattle were transported for the purpose of slaughtering and they were not provided with any water, food etc. Accused Nos. 1, 3 and 4 have been granted bail by the trial Court. The only accusation against the petitioner is that he loaded the cattle in the truck. Petitioner has undertaken to cooperate with the Investigating Officer in the investigation and abide by any conditions to be imposed by this Court. There

are no criminal antecedents of the petitioner. The offence alleged against the petitioner is not punishable either with death or imprisonment for life.

Considering the above aspects petitioner has

made out a case for grant of anticipatory bail with conditions.

In the result the following;

O R D E R

Petition is allowed. Petitioner is ordered to be

released on bail in the event of his arrest in Crime No. 143/2025 of Madhugiri Police Station subject to following conditions:

I. Petitioner shall voluntarily appear before the Investigating Officer within 15 days from this day and execute bail bond for a sum of Rs.1,00,000/-

with one surety for the likesum to the satisfaction of the Investigating Officer.

II. Petitioner shall cooperate with the Investigating

Officer in the investigation and appear before the Investigating Officer whenever called for.

IV. Petitioner shall appear before the trial Court on all dates of hearing unless exempted and cooperate for speedy disposal of the case, in case of filing of chargesheet.
