Petitioner is before this Court in this petition filed under Section 439(1)(b) of Cr.P.C. with a prayer to modify condition No. 'e)' imposed by this Court in Crl.P.No.8876/2025 disposed off on 14.07.2025.

Heard the learned counsel for the parties.

Petitioner herein is charge sheeted for the offences punishable under Sections 143, 147, 148, 449, 323, 307, 302, 120B, 109 and 342 of IPC and he is being tried for the charge sheeted offences in SC No.11/2019 (new SC No.11/2024) pending before the Court of the Principal District and Sessions Judge, Udupi. Petitioner along with other accused had approached this Court in Crl.P.No.8876/2025 seeking regular bail in the aforesaid case. This Court vide order dated 14.07.2025 has allowed Crl.P.No.8876/2025 subject to certain conditions. Condition No. (e) imposed by this Court in Crl.P.No.8876/2025 reads as follows:-

"e) The petitioners shall not leave the jurisdiction of the Trial Court without permission of

the said Court until the case registered against them is disposed off."

With a prayer to modify the aforesaid condition No. (e) , petitioner is before this Court in this petition filed under Section 439(1)(b) of Cr.P.C.

Learned counsel for the petitioner submits that condition No. e) has been causing untold hardship and injury to the petitioner and he is not in a position to attend his daily work. He submits that petitioner is a fisherman, who is required to leave the jurisdiction of the Trial Court for the purpose of his avocation.

Learned HCGP, who has opposed the prayer made in the application, however, fairly submits that the petitioner has no other criminal antecedents.

Considering the aforesaid aspects of the matter, I am of the opinion that if the prayer made in this petition is granted without altering or modifying the other conditions imposed in Crl.P.No.8876/2025, the same would serve the ends of justice. Accordingly, the following order:-

The criminal petition is allowed. Condition No. (e) imposed by this Court in Crl.P.No.8876/2025 vide order dated 14.07.2025 is relaxed. All other conditions imposed in Crl.P.No.8876/2025 shall remain unaltered.
