This petition is filed by accused No. 5 under Section 483 of BNSS praying to grant bail in Crime No. 181/2025 of Dibburahalli Police Station registered for offence under Sections 115, 85, 80(2), 108, 352 read with Section 3(5) of BNS and Sections 3 and 4 of Dowry Prohibition Act.

Heard learned counsel for petitioner and

learned HCGP respondent – State.

Learned counsel for petitioner would contend that the marriage of accused No. 1 with the deceased was a love marriage. At the time of marriage this petitioner – accused No. 5, being a far relative of accused No. 1, had extended financial help to accused No. 1. Petitioner is Anganawadi teacher and she is residing in a house situated by the side of house of the deceased. Merely because petitioner had extended financial help to accused

No. 1, father of the deceased has made false allegation and filed a false complaint against the petitioner. Petitioner is in judicial custody since 17.10.2025 and as major portion of investigation is over, she is not required for further custodial interrogation. Petitioner is a woman and she is Anganawadi teacher. With this he prayed to allow the petition.

Per contra learned HCGP would contend that petitioner is the daughter of maternal uncle of accused no.

1 and she is involved in three criminal cases. Petitioner used to visit the house of the deceased every day and used to interfere in their family affairs. Accused persons had given torture to the deceased and therefore she committed suicide. The matter is under investigation. If the petitioner is granted bail, there are chances of she hampering the investigation and tampering the prosecution process. With this, she prayed to reject the petition.

Having heard learned counsel for the parties

this Court has perused the FIR, complaint and other materials placed on record.

Marriage of the deceased with accused No. 1 was a love marriage. Said marriage had taken place without informing the same to the father of deceased. Petitioner is stated to have taken part in the said love marriage of accused No. 1 with the deceased and taken the deceased to their house. In that regard the complainant who is the father of the deceased has filed a complaint before the Police. It is alleged that petitioner and other accused used to harass and ill-treat the deceased demanding dowry. The deceased has committed suicide by consuming tablets on 09.10.2025 and she died on 11.10.2025 in the hospital. Petitioner is in judicial custody since 17.10.2025 and as the major portion of the investigation is over, she is not required for further custodial interrogation. Case stated to have been registered against her is regarding her family disputes.

Petitioner is Anganawadi teacher and is a woman. Considering the above aspects, petitioner has made out a

case for grant of bail with conditions.

In the result the following;

Petition is allowed. Petitioner is granted bail in Crime 181/2025 of Dibburahalli Police Station subject to following conditions.

¶47

I. Petitioner shall execute a personal bond for a sum of Rs.1,00,000/- with one surety for the likesum to the satisfaction of the jurisdictional Court.

II. Petitioner shall not tamper the prosecution witnesses either directly or indirectly.

¶49

III. Petitioner shall attend the trial Court on all dates of hearing, unless exempted and cooperate for speedy disposal of the case.
