This matter is listed for admission and matter is called twice in the morning and also in the afternoon, no representation on behalf of the petitioner.

The prayer is sought for quashing the order taking cognizance and issuance of process. On perusal of the order of the Trial Court, it discloses that the learned Judge has applied his judicious mind perusing the sworn statement of the complainant and documents filed in support of the case, particularly copy of the sale deed, mutation register, RTC and copy of the complaint lodged by the complainant before the police on 31.10.2006.

Having perused the same comes to the conclusion that the complainant has approached the police to take necessary action against the accused persons for cheating the complainant for non-payment of sale consideration amount as

agreed upon. Hence, comes to the conclusion that complainant has made a prima facie case and on perusal of the material on record, proceeded against the accused Nos.1 and 2 for the offences under Sections 420 and 506 of IPC. Hence, taken the cognizance.

When such detailed order has been passed, the learned judge while taking cognizance and issuing process applied his judicious mind and hence, there are no grounds to entertain the petition under Section 482 of Cr.P.C.

Accordingly, the petition is dismissed.
