The petitioners are before this Court calling in question the proceedings in C.C.No.12153/2024 registered for the offences punishable under sections 143, 147, 427, 448, 323, 324, 354, 504, 149 of the Indian Penal Code.

Heard Sri. Harsha Kumar Gowda H.R, learned counsel appearing for the petitioners, Sri. Channappa Earappa, learned HCGP appearing for respondent No.1, Sri. Udaya, learned counsel appearing for respondent No.2 and have perused the material on record.

During the pendency of the proceedings, the parties to the lis have settled the dispute among themselves and have filed a Compromise Petition in O.S.No.1330/2023 and the respondent No.2 have filed an affidavit before this Court to that effect. The affidavit filed by respondent No.2 reads as follows:

“I, Parvathamma, W/o Ningaiah, Aged about 66 years, Residing at 11th Cross, Chakranagar, Andrahalli, Bengaluru560091, do hereby solemnly state on oath as follows:

1. I, submit that, I am the Respondent No.2 in the above case and I know the facts of the case and accordingly I am deposing this affidavit.

2. I submit that, the petitioners have filed the above petition seeking to quash the entire Criminal Proceedings initiated against the petitioners in C.C. No.12153/2024 registered by the Byadarahalli Police station, Kengeri Sub-Division, Bengaluru city for the alleged offences punishable under section 143, 147, 427, 448, 323, 324, 354, 504, 149 of IPC, 1860 pending on the file of the Learned Chief Judicial Magistrate, Bengaluru Rural District, Bengaluru.

3. I submit that, my son namely Byrappa married to petitioner No.1 herein. The disputes were arose between the family. My son Byrappa filed the suit for Partition in O.S. No. 1330/2023 before the Learned III Addl. Senior Civil Judge, Bengaluru Rural District, Bengaluru against the petitioner No.1.

4. I submit that, the dispute between my son, petitioners and me was solved and agreed to file the compromise petition and accordingly the compromise petition was filed in O.S. No. 1330/2023. Wherein the petitioner No.1 agreed to give consent for the divorce filed by my son in M.C. No. 5780/2022. On my instruction my son filed the dispose compromise petition saying that I am agreed to co-operate of the C.C. No. 12153/2024 pending on the file of the Learned Chief Judicial Magistrate, Bengaluru Rural District, Bengaluru.

1 submit that, I have no objections to quash the entire Criminal Proceedings initiated against the petitioners in C.C. No.12153/2024 registered by the Byadarahalli Police station, Kengeri Sub-Division. Bengaluru city for the alleged offences punishable under section 143, 147, 427, 448, 323, 324, 354, 504, 149 of IPC, 1860 pending on the file of the Learned Chief Judicial Magistrate, Bengaluru Rural District, Bengaluru.

I submit that, I am deposing this affidavit out of free mind and without any undue influence.

Wherefore, I respectfully pray that this Hon'ble Court may be pleased to allow the above Criminal Petition by quashing the entire Criminal Proceedings initiated against the petitioners in C.C. No.12153/2024 registered by the Byadarahalli Police station, Kengeri Sub-Division, Bengaluru city for the alleged offences punishable under section 143, 147, 427, 448, 323, 324, 354, 504, 149 of IPC, 1860 pending on the file of the Learned Chief Judicial Magistrate, Bengaluru Rural District, Bengaluru, in the interest of justice and equity.
