This petition is filed by the petitioner –accused No.1

under Section 483 of BNSS praying to grant bail in Crime No.84/2025 of Hanumanth Nagar Police Station registered for offences punishable under Sections 109(1), 115(2), 324(4), 352 read with Section 3(5) of BNS.

Heard learned counsel for the petitioner and

learned High Court Government Pleader for the respondent -State.

Learned counsel for the petitioner would contend that the injured has sustained five injuries. Out of them, two injuries are grievous in nature. The injured has not been admitted in the hospital and he has been treated as an outdoor patient. As the charge sheet is filed, the

petitioner is not required for custodial interrogation. The petitioner is having aged parents, who are dependent on him. The complainant is also rowdy sheeter, which is mentioned in the statement of C.W.2. With these, he prays to allow the petition.

Per contra , learned High Court Government Pleader for the respondent –State would contend that the petitioner with the intention to kill the injured has assaulted with machete on his head and other parts and caused five injuries. Out of five injuries, two injuries are grievous in nature. The machete has seized at the instance of the petitioner. C.W.1 is injured and C.W.2 to C.W.4 are eye witnesses to the incident. The petitioner is rowdy sheeter and he is involved in several cases. If the petitioner is granted bail, there is threat to prosecution witnesses and chances of committing similar offence. With this, he prayed to reject the petition.

Having heard learned counsels, the Court

has perused the charge sheet and other materials placed on record.

¶38

The charge sheet indicates that there was an earlier quarrel between petitioner and the complainant on 31.03.2025. The petitioner with regard to the previous enmity on 13.04.2025 along with accused No.2 and juvenile accused came to the spot. At that time the, the injured asked the petitioner whether he has damaged his auto and for that the petitioner stated that he has damaged his auto and took out pepper spray and asked juvenile accused to spray it on the injured and he will assault him. The juvenile accused sprayed pepper spray on the injured and at that time, accused No.1 assaulted with machete on his head and other parts caused injuries and accused No.2 and juvenile have assaulted injured with cement brick on his back.

The wound certificate of the injured –C.W.1, indicate that he has sustained five cut lacerated wounds.

Out of them, one cut lacerated wound was over left parietal region of scalp measuring 7x2 centimeters. The CT scan of brain shows fracture over table of left parietal bone. The said injury has been caused on the head with machete. The said aspect itself indicates the intention of the petitioner to commit the murder of the injured. The petitioner is having criminal antecedents involved in three cases, namely Crime No.145/2023 of Girinagar Police Station for offence under Section 20(B) of NDPS Act; Crime No.149/2023 of Girinagar Police Station for offence under Section 25 of Arms Act and Crime No.84/2025 of Hanumanth Nagar Police Station registered for offences under Section 109 and other offences of BNS. Considering the said aspects, the petitioner is having criminal antecedents. If the petitioner is granted bail, there is threat to C.W.1 –injured, C.W.2 to C.W.4 -eye witnesses and other prosecution witnesses.
