Hennur Police Station, Bengaluru City for offences punishable under Sections 351(2) and 64 of BNS, 2023 and Section 66(E) of Information Technology Act, 2000 is before this Court in this petition filed under Section 483 of BNSS, 2023 seeking regular bail.

2. Heard the learned counsel for the parties.

Hennur Police Station, Bengaluru City for the aforesaid offences against the petitioner herein, based on the first information dated 21.07.2026 received from the victim lady, aged about 22

years. In the said case, petitioner was arrested on 21.07.2026 and remanded to judicial custody. His bail application filed before the jurisdictional Sessions Court in Crl.Misc.No.8095 of 2026 was rejected on 02.09.2026. Therefore, he is before this Court.

Learned counsel for the petitioner submits that the the petitioner is the brother-in-law of the victim girl and in view of certain domestic problems, she had approached the police and had filed a false complaint. He submits that the dispute between the family members has now been settled. Accordingly, he prays to allow the petition.

Per contra, learned High Court Government Pleader who has opposed the petition submits that investigation of the case is under progress.

Learned counsel appearing for respondent no.2 submits that the victim lady is present before the Court and she has no objection to grant bail to the petitioner since the dispute between them has been now settled.

A reading of the first information would go to show that the elder sister of the victim lady is married to the petitioner about 11 years prior to registration of FIR. In the present case allegation against the petitioner is that on 18.07.2026, he had brought some food from the hotel and after consuming the same, the victim lady had lost her consciousness and thereafter, petitioner allegedly had sexually assaulted her. It is further alleged that the petitioner thereafter threatened the victim lady that he had recorded her video and would circulate the same.

Learned counsel for respondent no.2 has now submitted that the victim lady had approached the police on wrong advice and the dispute between the parties has been now settled.

Considering the nature of allegation found in the first information as well as submission made by the parties concerned, I am of the opinion that the prayer made by the petitioner for grant of regular bail needs to be answered affirmatively. A ccordingly, the following:

(i) Criminal petition is allowed.

¶53

(ii) The petitioner is directed to be enlarged on bail in Crime No.385 of 2026 registered by Hennur Police Station, Bengaluru City for offences punishable under Sections 351(2) and 64 of BNS, 2023 and Section 66(E) of Information Technology Act, 2000, subject to the following conditions:

a) The petitioner shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with two sureties for the likesum, to the satisfaction of the jurisdictional Court;

b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons;

c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses;

d) The petitioner shall not involve in similar offences in future.

e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of
