The application is filed to quash the proceeding. The application is signed by the petitioner and the 2nd respondent.

The offence alleged are under Sections 115(2), 118(2) and 352 of The Bharatiya Nyaya Sanhita, 2023. The charge sheet is not yet filed.

The Court has perused the contents of the complaint. It appears from the reading of the complaint that a scuffle occurred on account of sudden provocation and it is not a premeditated act.

The complainant, who is present before the Court submits that he was in the hospital for three hours and was discharged on the same day.
