Accused No.3 in Crime No.177/2026 registered by Banaswadi Police Station, Bengaluru, for the offences punishable under Sections 118(1), 118(2), 352, 109(1), 238 and 190 of BNS, 2023, is before this Court in this successive bail petition filed under Section 482 of BNSS, 2023, seeking anticipatory bail.

Learned counsel for the petitioner submits that the allegation of assaulting injured victim with weapons is found against accused Nos.5 to 8. As against accused Nos.1 to 4, the allegation is of conspiracy. Accused Nos.1, 2 and 4 have been granted anticipatory bail by this Court in Crl.P.No.5883/2026 and Crl.P.No.7417/2026. The allegation against petitioner and accused Nos.1, 2 and 4, who have been granted anticipatory bail in the present case are similar. However, since petitioner had earlier approached this Court in Crl.P.No.6956/2026 and had withdrawn the same, the present petition may be

dismissed as not pressed with liberty to the petitioner to surrender before the jurisdictional Court and file necessary application seeking regular bail. He submits that in view of the aforesaid aspects of the matter, the concerned Court may be directed to consider the bail application of the petitioner on merits on the very same day.

Learned HCGP fairly does not oppose the said prayer made by learned counsel for the petitioner.

The submission made on both sides are taken on record. Petition is dismissed as not pressed with liberty as prayed for.

In the event, petitioner surrenders before the jurisdictional Court and files necessary application seeking regular bail, the same shall be considered and disposed off on merits by the said Court on the same day.
