In Crl.P.No.3636/2025, the petitioner is before this Court seeking the following prayer:

"WHEREFORE, the Petitioner above named, humbly prays that this Hon'ble Court be pleased to quash the FIR and all subsequent proceedings registered by Annapoorneshwari Nagar Police Station against the Petitioner under Crime No.220/2021 dated 26.09.2021, i.e., Annexure-A, and a subsequent charge sheet filed by the Respondent No.1 police dated 26.01.2022 in Criminal Case No.2342/2022 for the offences punishable under Sections 498A of the Indian Penal Code and Section 4 of the Dowry Prohibition Act, pending on the file of the Hon'ble V Additional Chief Metropolitan Magistrate Court, Bangalore, as per Annexure-C, in the interest of justice and equity."

In Crl.P.No.12526/2024, heard Sri.M.B.Ravikumar, learned counsel appearing for the petitioner, Sri.B.N.Jagadeesha, learned Addl. SPP appearing for respondent No.1, Sri.Bhairav G.V., learned counsel appearing for respondent No.2 and have perused the material on record.

During the pendency of the proceedings, the parties to the lis have settled the dispute among themselves and have filed a Memorandum of Compromise Petition in Crl.P.No.3636/2025. The said Memorandum of Compromise Petition reads as follows:

Bengaluru do hereby solemnly affirm and state on oath as follows:

It is submitted that the Petitioner and the Respondent.No.2 are well aware and conversant with the facts and circumstances of the above petition, and hence the Petitioner and Respondent No.2 are signing this compromise petition by way of a Joint Memo.

It is further submitted that the Petitioner is Accused in Cr.No.220/2021 dated: 26.09.2021 before the Annapoorneshwari Nagar Police Station, respondent No.1 herein for the offences punishable under Sections 498A of Indian Penal Code r/w Section 4 of the Dowry Prohibition Act, 1961.

It is further submitted that, the above petition is filed by the Petitioner to quash the F.I.R dated 26.09.2021 against the petitioner in Cr.no.220/2021 and the subsequent chargesheet filed by the Annapoorneshwari Nagar Police Station for the offence punishable under section 498A of IPC r/w Section 4 of the Dowry Prohibition Act, 1961 and the entire proceedings in C.C.No.2342/2022 pending before V Additional Chief Judicial Magistrate, Bangalore for the offenses punishable under Sections 498A of the Indian Penal Code & Section 4 of the Dowry Prohibition Act, 1961 against the Petitioner in the interest of justice.

Thereafter upon the intervention and counselling by the well-wishers, an amicable settlement is arrived at between the parties and in terms thereof, the Respondent No.2 has agreed to withdraw all the allegations made against the Petitioner and thereby the Respondent No.2 has no objection for this Criminal Petition in Crl.P. No.3636/2025 and for the FIR in Crime No.220/2021 dated 26.09.2021 for offences punishable 498A, of I P C r/w Section 4 of the Dowry Prohibition Act, 1961 which is now pending before the Hon'ble V Additional Chief Judicial Magistrate, Bangalore in C.C.No.2342/2022 to be quashed.

The parties have amicably resolved all disputes

The Respondent No.2 hereby unequivocally declares that:

Both the Petitioner and Respondent No.2 has no surviving financial, civil, matrimonial, or criminal claims against each other.

It is further submitted that, in view of the compromise arrived between the Petitioner and Respondent No.2 agree to withdraw all other allegations made against each other before any forum or court and they further undertake that either of them will not file any case against the each other or their family or relative. They also undertake to withdraw all other cases pending against each other across various forums.

It is further submitted that the said compromise is entered into by the Petitioner and Respondent no. 2 with their own consent and there is no coercion or undue pressure created by any third parties to enter into this compromise.

It is further submitted that, the dispute between Petitioner and Respondent No.2 is amicably settled and are willing to lead a prosperous life and have new beginning. The Petitioner and Respondent No.2 undertake and will ensure that they, their family members, their relatives, their friends and all the persons will not interfere with each other's lives or contact each other and will not circulate or publish any information relating to the each other in any manner, in the future.

It is further submitted that if this compromise petition is not accepted, Petitioner and Respondent No. 2 will be put to greater hard ship and inconvenience which cannot be compensated in any manner.

WHEREFORE, It is humbly prayed before this Hon'ble court that it may be pleased to allow this compromise petition and consequently allow the Criminal Petition by Quashing the F.I.R dated 26.09.2021 against the petitioner in Cr.no.220/2021 and the subsequent chargesheet filed by the AnnapoorneshwariNagar Police Station for the offence punishable under section 498A of IPC r/w Section 4 of the Dowry Prohibition Act, 1961 and the entire proceedings in C.C.No.2342/2022 pending before V Additional Chief Judicial Magistrate, Bangalore against the Petitioners in the interest of justice.”

“We, Smt. SINDHU S.N. D/o Late Nanjundegowda, Aged about 36 years, R/at Flat No.2, No.82, J.C. Coral Apartment, Jayalakshmamma Layout, Nagarabhavi II Stage, Bangalore560 072 and Sri. Goutham H.K., S/o Late Krishnegowda, Aged about 42 years, R/at Flat No.2, No.82, J.C. Coral Apartment, Jayalakshmamma Layout, Nagarabhavi II Stage, Bangalore - 560 072, the Petitioner and Respondent No.2, do hereby solemnly affirm and state on oath as follows:

We submit that Sri. Goutham H.K. has lodged a complaint against me before the Annapoorneshwarinagar Police Station, Bengaluru and the said police have filed charge sheet against me for alleged offences punishable under section 341 & 323 of IPC.

We submit that, we have filed the aforesaid Petition under section 482 of Cr.P.C. to Quash the entire Proceedings in CC No.4567/2022 and to acquit me on the file of Hon'ble VI Addl. Chief Judicial Magistrate Bengaluru Urban District, Bengaluru.

We submit that in view of the aforesaid circumstances myself the Petitioner and Respondent No.2 are not in position to contest the matter in order to buy a peace in our day to day life and with the intervention of well-wishers, elders and friends. We have compromised in the aforesaid matter. Hence, we are praying this Hon'ble Court to close the aforesaid case by accepting this Joint Affidavit and the Criminal Petition may be allowed in the interest of justice.
