Madanayakanahally Police Station, Bengaluru City for the offences punishable under Section 103(1), 115(2), 351(2), 352 and 3(5) of BNS, 2023, is before this Court in this petition filed under Section 483 of BNSS, 2023 seeking regular bail.

from Manjunatha brother-in-law of deceased Ravi. In the said case, the petitioner was arrested on 17.07.2026 and remanded to judicial custody. His bail application filed before the jurisdictional Sessions Court in Crl.Misc.No.1615 of 2026 was rejected on 10.08.2026. Therefore, he is before this Court.

Material available on record would go to show that Manjunatha and his brother-in-law Ravi were both working as masons. It appears that Manjunatha and his brother-in-law Ravi had constructed a sump in the property of Devaraju (accused No.2). On 16.07.2026, Devaraju had telephoned Manjunatha and informed him that the door of the sump was broken and it required repair. The Manjunatha allegedly had informed Devaraju that on the next day he would come to the site and repair the sump door. It appears that subsequently, there was an exchange of words between Manjunatha and Devaraju over phone. Thereafter, at about 07.00 p.m. on the same day, Devaraju came in search of Manjunatha near his

house along with three others and allegedly had quarreled with Manjunatha. Thereafter, Devaraju and his son assaulted Manjunatha. When Ravi tried to interfere, a boy who had come along with Devaraju allegedly assaulted Ravi and thereafter, at the instance of Devaraju his son assaulted Ravi with his hands and legs on his chest and also on his private parts. Immediately thereafter, Ravi fell down and he was not in a position to get up. Therefore, he was shifted to hospital but in the hospital, he died while undergoing treatment. It is under these circumstances, FIR was registered against the son of the Devaraju.

During the course of investigation, the further statement of Manjunatha (CW1) has been recorded in the present case and allegation of assaulting Ravi with hands and legs on his chest and private parts are found in the further statement only against accused No.1 Mithun, who is the son of Devaraju. Though, the petitioner is also the son of Devaraju, there is no allegation against him about he assaulting Ravi on his chest and private parts. All the

four accused persons named in the present case have been arrested. Major portion of the investigation is completed. The petitioner is a youngster having no other criminal antecedents.

Considering the nature of allegations as against

him and also stage of investigation, I am of the opinion that the prayer made by the petitioner for grant of regular bail needs to be answered affirmatively, subject to appropriate conditions. Accordingly, the following:

(i) The Criminal Petition is allowed. The petitioner is directed to be enlarged on bail Crime No.692 of 2026 registered by Madanayakanahally Police Station, Bengaluru City for the offences punishable under Section 103(1), 115(2), 351(2), 352 and 3(5) of BNS, 2023, is before this Court in this petition filed under Section 483 of BNSS, 2023, subject to the following conditions:

a) The petitioner shall execute personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court;

¶55

b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons;

¶56

c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses;

¶57

d) The petitioner shall not involve in similar offences in future;

¶58

e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
