The appellant being aggrieved by the order dated 12.01.2026 passed in Criminal Miscellaneous Petition No.1929/2025 on the file of the III Additional District and Sessions Judge at Tumakuru, by which the trial Court had dismissed his application filed under Section 482 of BNSS

The case of prosecution is that on 14.11.2025 at

about 02.00 a.m., a complaint was registered before the respondent - Police alleging that one Abhishek had left the house with his neighbours Ranjith and Harish @ Current on 13.11.2025 at 04.00 p.m. That around 11.56 p.m., a relative of the complainant namely, Ullas Kumar, received a phone call from one Ranjith, informing him that certain unknown persons had assaulted Abhishek with deadly weapon in a vacant area located at Gokula Layout, Baddihalli and the said Abhishek had been taken to Siddaganga Hospital for treatment. Immediately thereafter, the complainant had gone to Siddaganga Hospital at 12.05 a.m. On the following day he learnt that his brother Abhishek, who had sustained serious injuries on his face and other parts of the body, had succumbed to the injuries. Hence the complaint.

After the investigation, the police have filed the charge sheet. The police have arrested accused Nos.1 to 9 on 15.11.2025 at 11 a.m., recorded their voluntary

Referring to the aforesaid prosecution material,

the counsel for the appellant submits that according to allegations, it was the deceased who had assaulted the accused No.2/appellant with a chopper which was stuck in his head and accused No.5 had released the chopper from the head of the accused No.2 and had chased deceased Abhishek, who was joined by accused Nos.1, 3, 4, 6, 7, 8 and 9. The deceased was thereafter assaulted by the said accused persons resulting in his death. He therefore submits that the charge sheet material do not indicate accused No.2 assaulting the deceased in any manner whatsoever as he himself was injured and unconscious and

he was taken to the hospital for treatment. Since there is

no overt-act attributed to accused No.2, except he being present at the spot, no prima facie case is made out against him.

He further submits that the accused No.2/appellant is suffering from Hepatitis C virus disease which is highly contagious and terminal. He furnishes communication issued by Siddaganga Hospital to the Police Inspector, Jayanagar Police Station, which reads as under:

"This is to certify that Mr. Manoj kumar, aged 27 years, with an alleged history of physical assault, was admitted to our hospital on 14/11/2025 with IP No. IP25-56431. The victim's blood-stained clothes were collected at the time of admission. Subsequently, the victim's blood sample tested positive for HCV. It can spread to another person through blood.

The collected clothes have been sealed, labelled as Biohazard, and preserved as per protocol. It is hereby informed that all personnel involved in handling these evidentiary materials are instructed to

exercise utmost caution and follow standard biohazard safety measures."

Thus referring to the aforesaid aspect of the matter, he submits that even if the accused is arrested, due to the disease being suffered by him which is highly contagious, the police would not be in a position to retain him without providing extraordinary medical care which is required to treat the disease of this nature. Hence seeks for granting of pre-arrest bail.

Learned HCGP does not dispute the fact of the accused No.2/appellant suffering from Hepatitis C disease and the same being highly contiguous. He submits that as

per the charge sheet material, accused No.2 is the aggressor though he sustained the first assault at the hands of the deceased. He had lent to the situation and therefore, he is arrayed as accused No.2 in the charge sheet. Hence seeks for dismissal of the application.

The alleged incident had taken place on

13.11.2025 at about 11.56 p.m. After the investigation, the police have filed the charge sheet. The portion of the charge sheet referring to the involvement of accused No.2, as already noted above, indicates that though he was present at the spot at the time of incident, the deceased had assaulted him with a machete which was stuck in his skull and thus he had fallen unconscious.

The further contents of the said portion of charge sheet would indicate that accused No.5 had removed the said machete from the head of the accused No.2/appellant and being enraged had chased the deceased accompanied by the other accused persons and this clearly indicates that accused No.2 had not assaulted the deceased. The contention of the HCGP whether accused No.2 had lent to

the situation to arise or not is a matter of trial.

HCV disease, which according to the prosecution records,

is highly contagious and special care is required to be taken by all the persons involved in the handling of the evidentiary material and the accused, in the absence of

any special grounds made out by the prosecution in the nature of providing special treatment, at this juncture, this Court deems it appropriate to allow the appeal, granting anticipatory bail subject to following conditions.

(1) The criminal appeal is allowed .

(2) The order dated 12.01.2026 passed in Crl.Misc.No.1929/2025 on the file of the III Additional District and Sessions Judge at Tumakuru is set aside.

(3) The appellant shall be released on bail, in the event of his arrest in Crime No.194/2025 registered by Jayanagara Police Station for the offences punishable under Sections 103(1), 189(2), 191(2), 191(3) read with Section 190 of Bharatiya Nyaya Sanhita (BNS), 2023 and under section 3(2)(v) of the SC/ST (POA) Act, subject to following conditions:

(i) The appellant shall execute a bond for a sum of Rs.1,00,000/- with two sureties for the likesum.

(ii) The appellant shall appear before the trial Court within 15 days from the date of receipt of certified copy of this order and shall also appear before the jurisdictional Court and obtain regular bail.

(iii) The appellant shall not leave the jurisdiction of the trial Court without prior permission.

(iv) The appellant shall not influence or in any manner tamper with the prosecution witnesses.
