Heard learned counsel for the petitioner and learned High Court Government Pleader for respondent No.1.

Learned counsel for the petitioner would submit that the dispute raised is a civil dispute, wherein the complainant has lodged a complaint alleging that the sale deed has been executed in the name of the complainant's mother, Smt. Kiran Kumari.

The sale deed was executed in the year 2022. It is alleged that the petitioner's mother, Smt. Kiran Kumari, died in

the year 2017. Thus, the allegation is one of impersonation and forgery.

Learned counsel for the petitioner would further submit that the complaint is filed four years after the execution of the registered sale deed and that the remedy available to the complainant is to file a civil suit.

The Court is unable to accept the contention. The allegation is that the owner of the property died in the year 2017 and the sale deed was executed in the name of the deceased person in the year 2022. The matter requires investigation.

Accordingly, the petition is dismissed .
