This appeal is preferred against the judgment of acquittal dated 28.02.2024 passed in CC No.320 of 2021 by the Principal

Senior Civil Judge and JMFC at Belthangady, Dakshina Kannada.

It is submitted by the learned counsel for the appellant that this appeal may be transferred to the District Judge in view of the judgment of Hon'ble Supreme Court in the case of CELESTIUM FINANCIAL v. A GNANASEKARAN ETC. reported in 2025 SCC ONLINE SC 1320. In the light of the submission made by the learned Counsel for the appellant as also keeping in mind the aforestated judgment of Hon'ble Supreme Court, this appeal stands disposed of transferring the case to concerned District Court for disposal.
