Accused in Crime No.69 of 2025 registered by Varthur Police Station, Bengaluru city for offence punishable under Section 103 of BNS, 2023 is before this Court in this petition filed under Section 483 of BNSS, 2023 seeking regular bail.

Heard the learned counsel for the parties.

FIR in Crime No.69 of 2025 was is registered by

Varthur Police Station, Bengaluru for the aforesaid offence against the petitioner, based on first information dated 22.02.2025, received from Sri Arvinda N. During the course of investigation, petitioner herein was arrested on 22.02.2025 and remanded to judicial custody. After completing investigation, charge sheet has been filed against him for the aforesaid offence. Bail application filed by the petitioner before the jurisdictional Sessions Court in Crl.Misc.No.1111 of 2025 was rejected on 02.07.2025. Therefore, he is before this Court.

In the first information that was submitted on 22.02.2025, it is stated that on 21.02.2025 at about 07.30 p.m. when the first informant was in his house, he heard some noise outside his house and when he came out, he found one person holding a knife was assaulting with the same on another. At that time, his neighbour Smt. Meena came out of the house and started shouting that her husband and her friend Kishore were fighting each other. Thereafter, the persons who had gathered near the spot of crime shifted injured Kishore to a hospital. On enquiry, Smt. Meena allegedly informed the first informant that the person who had assaulted Kishore with the knife was her husband Satish. In respect of the alleged incident that had taken place at about 07.00 p.m. on 21.02.2025 FIR was registered on 22.02.2025 at about 01.15 a.m. During the course of investigation petitioner was arrested on 22.02.2025 and remanded to judicial custody.

In the charge sheet which is filed thereafter it is alleged that petitioner and his wife CW4 Smt. Meena were residing in a rented house in Sun City Layout at Kodati Grama along with their two children. The deceased Kishore, who

allegedly was the classmate of CW4 - Smt. Meena used to visit

the said house and in spite of objections raised by the petitioner, CW4 and deceased were meeting each other. Therefore, the petitioner had changed the rented house. Kishore started visiting even the said house though the petitioner had objected for the same. CW4 - Smt. Meena therefore, had decided to give divorce to the petitioner and resultantly marital relationship between petitioner and his wife CW4 - Smt. Meena got strained. Allegation in the charge sheet is that in this background petitioner had a vengeance against Kishore Kumar. Though in the charge sheet it is alleged that on 21.07.2025 petitioner armed with a knife had gone near the house where his wife was staying and when Kishore Kumar came there, petitioner allegedly confronted him and assaulted him with a knife, none of the witnesses have spoken about the same.

CW1, CW4 and CW7 are the alleged eyewitnesses to the incident in question. All these witnesses have stated that after hearing some noise, they came out and saw the petitioner and Kishore Kumar fighting with each other. The charge sheet

material would go to show that in the incident in question, petitioner had sustained injuries and on 21.02.2025 itself at about 08.30 p.m. he had gone to Suraksha Hospital at Varthur in Bangalore and was admitted in the said hospital. The history given by him in the said hospital about the injuries is assault by known person Kishore. None of the charge sheet witnesses have spoken about the injury sustained by the petitioner in the alleged incident. Therefore, it is apparent that prosecution has failed to explain the injuries suffered by the petitioner in the incident in question.

Petitioner, who has no other criminal antecedent, is in custody from 22.02.2025. He is a married man having two minor children. Considering the aforesaid aspects of the matter and also taking into consideration the background in which the incident in question had taken place, I am of the opinion that the prayer made by the petitioner for grant of regular bail needs to be answered affirmatively.

Criminal petition is allowed.

The petitioner is directed to be enlarged on bail in Crime No.69 of 2025 registered by Varthur Police Station, Bengaluru city for offence punishable under Section 103 of BNS, 2023, subject to the following conditions:

a) The petitioner shall execute a personal

bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with two sureties for the likesum, to the satisfaction of the jurisdictional Court;

b) The petitioner shall appear regularly on

all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons;

c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses;

d) The petitioner shall not involve in similar offences in future.
