Petitioners, who are apprehending arrest in Crime No.1/2026 registered by Jalgoan Cyber Police Station, Jalgoan, Maharashtra State, for the offences punishable under Sections 318(4), 3(5) of BNS, 2023, and Section 66(D) of Information Technology Act, are before this Court in this petition filed under Section 482 of BNSS, 2023, seeking transit anticipatory bail.

FIR in Crime No.1/2026 is registered by Jalgoan Cyber Police Station, Jalgoan, Maharashtra State, for the aforesaid offences against unknown persons. It appears that petitioners herein have received inquiry notice under Section 35(3) of BNSS, 2023, from the Investigation Officer, and therefore, they are apprehending arrest in the case.

Learned Counsel for the petitioners has submitted that petitioner no.1, aged about 79 years, is the Director of a Software Company, and petitioner no.2 is working in the said company. They intend to approach the jurisdictional Court at Maharashtra and file necessary application seeking anticipatory

bail and only to enable them to approach the said Court, a request is made for transit anticipatory bail for a limited period.

It is not in dispute that petitioners do not have any criminal antecedents and the law with regard to the powers of this Court to grant transit anticipatory bail has been pronounced by the Hon'ble Supreme Court in the case of PRIYA

Considering the nature of allegations found in the FIR and also the background of the petitioners, I am of the opinion that the prayer made by the petitioners for grant of transit anticipatory bail for a limited period to enable them to approach

the jurisdictional Court at Maharashtra and file necessary application seeking anticipatory bail in Crime No.1/2026 registered by Jalgoan Cyber Police Station, Jalgoan, Maharashtra State, is required to be granted. Accordingly, the following order:

The petition is allowed. The petitioners are granted interim anticipatory bail in Crime No.1/2026 registered by Jalgoan Cyber Police Station, Jalgoan, Maharashtra State, for the offences punishable under Sections 318(4), 3(5) of BNS, 2023, and Section 66(D) of Information Technology Act, for a limited period of three weeks from the date of receipt of the copy of this order, so as to enable the petitioners to approach

the jurisdictional Court at Maharashtra seeking necessary reliefs in the aforesaid case. In the meanwhile, in the event of their arrest in the above case by the respondents, they shall be released, subject to the following conditions:
