Learned counsel for the petitioner submits that, inadvertently this criminal petition is filed under Section 438 of BNSS, 2023 instead of filing an appeal as provided under Section 14(A)(2) of SC/ST (POA) Amendment Act, 2015. He submits that, therefore the petitioner may be permitted to convert this criminal petition into a criminal appeal as aforesaid.
