At the outset, learned counsel for the petitioner submits that the present petitioner is accused No.8, who had resigned from the directorship much prior to the incident which is the subject matter of the present petition.

It is further submitted that this Court has already quashed the pending proceedings insofar as the accused by name Vipul Prakash Patil is concerned.

Taking note of the fact that the present petitioner, being an erstwhile Director of Janasneha Real Wealth and Solutions Private Limited, cannot be held responsible for the alleged fraud and non-deposit of amounts.
