That in the above case, the petitioners have challenged the FIR and complaint filed by the respondent No.1 with instigation of respondent No.2 bearing in Market P S Crime. No.67/2017 registered by the respondent for the alleged offences punishable under section 420, 465, 468, 467, 471, 464 of IPC1860 R/W Sections 436(A) of Karnataka Municipal Corporation Act, therefore the petitioners may kindly be permitted to withdraw the above petition and liberty may kindly reserve for the petitioner after filling of the charge sheet filed in Market P S Crime. No. 67/2017 and liberty to file the fresh petition, in the interest of justice and equity.”
