This petition is filed to quash the proceedings in Special Case No.10/2026 pending before the Sessions Judge, Tumkuru arising from Crime No.225/2025 registered before Pavagada Police Station.

Learned counsel appearing for the petitioners would

submit that the two alleged eyewitnesses cited in the charge sheet are the friends of the complainant and no case is made out to try the petitioners for the alleged offences.

Learned HCGP would submit that the contentions

raised by the petitioners are based on disputed questions of facts and they have to be considered after the trial.

The Court has considered the contentions raised.

After going through the contents of the complaint where the offences are alleged under Sections 351(2), 352 read with Section 3(5) of Bharatiya Nyaya Sanhita, 2023 and Sections 3(1)(r)(s) and 3(2)(va) of Scheduled Castes and Scheduled Tribes (Prevention of Attrocities) Act, 1989, the Court is of the view that all the contentions raised by the petitioners are to be considered by the Trial Court after the trial. Hence the petition is dismissed .

The observations made in this order are only confined to the merits of the petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 and not on the merits of the contentions to be raised by the petitioners before the Trial Court.
