THIS CIVIL MISCELLANEOUS PETITION IS FILED UNDER SECTION 11(4)(5) AND (6) OF ARBITRATION AND CONCILIATION ACT, 1996, PRAYING TO APPOINT A SOLE ARBITRATOR FOR THE PURPOSE OF ADJUDICATION OF THE DISPUTES BETWEEN THE PETITIONER AND RESPONDENTS UNDER THE REGISTERED TWO AGREEMENTS OF SALE DATED 15^TH JUNE, 2024 THAT WERE REGISTERED ON 26^TH AUGUST, 2024 BEFORE THE OFFICE OF THE SUB-REGISTRAR, MAHADEVPURA, BENGALURU AS PER ARBITRATION CLAUSE AT CLAUSE NO.14.17 VIDE ANNEXURES 'H' AND 'J'.

In this petition, the petitioner is seeking an appointment of sole Arbitrator to adjudicate the dispute between the petitioner and respondents as per Clause 14.17 of the Agreements for Sale dated 15^th June, 2024 which were registered on 26^th August, 2024 vide Annexures 'H' and 'J'.

Heard Sri. Shravan S. Lokre, learned counsel appearing for the petitioner and Sri. Prashanth M.V., learned counsel appearing for respondents.

Having taken note of the submission made by learned counsel appearing for the parties, I have carefully perused Clause 14.17 of the Agreements for Sale dated 15^th June, 2024 registered on 26^th August, 2024 (Annexures 'H' and 'J'), which provides for resolution of dispute between the parties through an Arbitration. In that view of the matter, I am of the view that, a former judge of this Court be appointed as Arbitrator to resolve the dispute between the parties.

Therefore, Hon'ble Mr. Justice P.N. Desai, Former Judge of this Court is appointed as an Arbitrator to resolve the dispute between the parties in the Arbitration and Conciliation

All claims and contentions of the parties are kept open to be decided by the Arbitral Tribunal.

A copy of this order be sent forthwith to the Arbitration and Conciliation Centre (Domestic and International), Khanija Bhavan, Bengaluru for proceeding further in the matter.

Registry is directed to return the original documents if any, produced by the parties, after obtaining photostat copy of the same for the file.
