The petitioner and the respondents are parties to the Agreements dated 16.08.2023, 11.01.2024 and 07.09.2023. There is exchange of notices and also proceedings under Section 9 of the Arbitration and Conciliation Act, 1996 [for short, 'the Act' ]. It would suffice for this Court to observe that there is no dispute about the existence of an arbitration agreement and an arbitral dispute.

When queried, it is stated on behalf of the respondents that the objection is as regards the appointment of the petitioner's nominee as the sole arbitrator. This objection need not detain this Court in the disposal of the petition as this Court can appoint another arbitrator to enter reference of the dispute at the Arbitration and Conciliation Centre
