The petitioner is before this Court seeking the following reliefs:

i. Appoint a sole Arbitrator for the purpose of adjudication of the disputes between the petitioner and the respondents under the registered agreements of sale dated 15.06.2024 that was registered on 26.08.2024 before the office of the Sub-Registrar, Mahadevpura, Bangalore as per Arbitration clause at clause No.14.17 at Annexure-‘H’.

ii. Pass such other orders as this Hon’ble Court may deem fit and necessary in the above Civil Miscellaneous petition in the above case in the interest of justice and equity.

After arguing the matter for some time, the learned counsel for the respondent submits that a suitable arbitrator could be appointed, leaving all contentions open to be decided by the said arbitrator. In that view of the matter, I pass the following:

i. The Civil Miscellaneous Petition is allowed .

ii. Hon’ble Justice Sri. P.N.Desai, Former Judge, High Court of Karnataka, is appointed as a sole Arbitrator to arbitrate the dispute between the parties under the aegis of the Arbitration Centre attached to this Court.

iii. Registry is directed to forward a copy of this order to the Director, Arbitration and Conciliation Centre for doing the needful.

iv. All the contentions of the parties are kept open.

v. Registry is directed to return the original and/or certified copies, if produced, to the respective parties who have produced it/them by following due procedure.

vi. Pending application/s, if any, shall stand disposed of accordingly.
