This Contempt of Court Case is filed alleging willful disobedience of the Order dated 21.02.2019 passed in I.A.Nos.1/2019 and 2/2019 in RSA No.108/2017 C/w RSA No.107/2017. The primary contention of the complainant is that in violation of the temporary injunction Order of this Court, the accused has put up a construction.

The accused has entered appearance and filed an affidavit dated 20.01.2026. We have perused the entire affidavit. Paragraphs No.6 to 9 of the affidavit reads as under:

6. I further submit that I have not disobeyed the order of this Hon'ble Court willfully and the delay in complying with the Orders of this Hon'ble Court is due to the negotiations with S.R. properties regarding the cancellation terms which is a bona fide reason and not intentional.

7. I submit that I am residing in a house built up on Sy.No.20/7, in the year 2023, I renovated the house for the sake of my children's marriage as the existing house

was very old and had water leakage issues. I shall abide by the final order in FDP proceedings and I shall also not claim any equity.

8. I submit that I have fully complied with the Orders

of this Hon'ble Court and have cancelled the Agreement

¶35

of sale dated 10.12.2018. I am herewith producing a copy of the Cancellation Deed of Sale Agreement for kind perusal of this Hon'ble Court along with this affidavit.

9. I hereby tender my unconditional apology for the delay in compliance with the orders of this Hon'ble Court. If this Hon'ble Court does not drop the charges framed against me and proceed further, I will be put into great hardship.

We have perused the aforesaid averments made in the affidavit. The accused has sought unconditional apology and expressed regret for the act done by him and also stated that he will not claim any equity. Considering the fact that the regular proceedings in RSA No.108/2017 C/w RSA No.107/2017 are pending, we are of the view that the unconditional apology by the accused can be accepted. Accordingly, the same is accepted. In view of the above, the Contempt of Court Case is dropped .
