Karnataka High Court (S Vishwajith Shetty, J.), Bengaluru, order dated 23.06.2026 in CRL.P No. 9910 of 2025 (NC: 2026:KHC:30925): The State (by Attibele Police Station, now transferred to CID) filed this petition under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 praying for cancellation of the anticipatory bail granted to the respondent by the IX Additional District and Sessions Judge, Bangalore Rural District, by order dated 13.12.2024 in Criminal Miscellaneous No.2584/2024 in Crime No.356/2022 (registered by Attibele Police Station) for offences punishable under Sections 7(A), 7(C) of the Prevention of Corruption Act, 1988 and Sections 423, 424, 120-B, 149, 421, 465 and 468 of the Indian Penal Code. Subsequent to the bail, a charge sheet was filed; the respondent's discharge application under Section 227 Cr.P.C. was rejected, and in Criminal Revision Petition No.88/2026 this Court, by order dated 03.02.2026, stayed further proceedings in the crime against the respondent. The State is before this Court in this Criminal Petition filed under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 with a prayer to cancel the anticipatory bail granted to the respondent vide Order dated 13.12.2024 passed in Criminal Miscellaneous No.2584/2024 by the Court of IX Additional District and Sessions Judge, Bangalore, Rural District, Bangalore.

Heard the learned counsel for the parties.

It is brought to the notice of this Court that respondent herein was granted anticipatory bail by the Court of IX Additional District and Sessions Judge, Bangalore, Rural District, Bangalore, vide Order dated 13.12.2024 in Criminal Miscellaneous No.2584/2024 in Crime No.356/2022 registered by Attibele Police Station, Bangalore Rural District for offences punishable under Sections 7(A), 7(C) of Prevention of Corruption Act, 1988 and Sections 423, 424, 120-B, 149, 421, 465 and 468 of Indian Penal Code.

Subsequent to grant of anticipatory bail, charge sheet has been filed in the present case and respondent herein thereafter had filed an application under Section 227 of Cr.P.C. before the jurisdictional Court seeking his discharge.

It appears that the said application was rejected and therefore the respondent has approached this Court in Criminal Revision petition No.88/2026 and this Court by order dated 03.02.2026 has stayed the further proceedings in Crime No.356/2022 in so far as the respondent in concerned.

Under these circumstances, at this stage, the present petition filed on behalf of the State with a prayer to cancel the anticipatory bail to the respondent cannot be considered on merits.
