Sathyavathi v. Kashinath Rao
Case brief
What is this about?
Article 227 writ (GM-CPC); Karnataka HC Bengaluru; S Vishwajith Shetty; FDP.No.25035/2011; O.S.No.11210/1998; RFA.No.2157/2010; Order XX Rule 18(1) CPC; IA.no.9; modification of preliminary decree; final decree proceedings; death of issueless sharer K.Jana Bai; succession — siblings entitled equally to deceased sibling's estate; brothers 1/4th share each; LXVII Addl. City Civil & Sessions Judge (CCH-58) Mayohall Unit; sale deeds plea raised for first time; writ petition dismissed.
What did the court decide?
It is not in dispute that K.Jana Bai had separated from her husband and had died issueless; therefore, after her death her siblings would be entitled to equal share in her estate. The Trial Court accordingly enlarged the shares and held that after the death of K.Jana Bai her four brothers, viz., K.Kashinath Rao, K.Vittal Rao, K.Subramani Rao and K.Ganesh Rao, are entitled to 1/4th share each in the suit schedule properties (instead of 1/5th); the High Court finds no illegality in the order.
