Heard the Petitioner-Party-in-person and the learned counsel for the respondent No 2. person.

The petitioner enrolled for three years LL.B. course at respondent No.2-College. The petitioner cleared all the subjects but one subject “Law of Evidence” in the 6th semester examination with a score of 24 out of 80 marks leading to his failure in the said subject.

Party-in-person states that after reviewing the answer script, the petitioner applied for challenge valuation, which resulted in a slight increase of 2 marks, totaling 26, still below the passing mark of 32. The petitioner submitted a grievance letter for revaluation to the respondent No 2-college with a request to forward the same to the registrar (Evaluation).

The inaction on part of the respondents on the grievance letter seeking redressal of his grievances regarding the revolution of answer script has made the petitioner to approach this Court.

Petitioner, taking this Court to Annexure-A-the Karnataka State Law University Examination Ordinance, 2014 (hereinafter referred to as "KSLU Ordinance” for short) at clause No.2.2, which reads as under:

"2.2 The candidate may apply for revaluation and challenge within the stipulated time. However he/she is permitted to withdraw the application for challenge valuation if he gets the benefit in the revaluation."

submits that the candidates can challenge and apply for revaluation within the stipulated time and though he made necessary application for revaluation, the representation is not yet considered.

Per contra, learned counsel for respondent No.1

submits that representation is given to respondent No.2College, if representation is submitted to respondent No.1, the same would be considered in accordance with law.

Recording the submission of the counsel for respondent No.1, the grievance of the petitioner would be meted, if necessary directions be given. In the said circumstances, the petitioner to submit the representation to respondent No.1 by 16.01.2025, respondent No.1 thereafter to consider the representation of the petitioner by 17.01.2025 bearing in mind clause 2.2 of the KSLU Ordinance.

With the said observations, the present writ petition stands disposed of.
