The Demand Notice dated:07.12.2019 issued by the Recovery Officer of DRT-2, Bengaluru in R.C.No.1267/2018 vide Annexure-L is called into question in this Writ Petition on several grounds as setout in the Memorandum of Writ Petition.

Counsel for the respective parties urged several contentions. Heard the arguments and perused the Writ papers with care.

Suffice it to note that the recovery case is pending adjudication before the DRT and the petitioner is a party to the proceedings. If at all, the petitioner has any grievance he can agitate the same before the Tribunal. The Writ Petition is devoid of merits and is liable to be rejected.
