The petitioner has sought for a writ in the nature of mandamus to direct the respondents to consider his representations dated 15.11.2022 and 03.07.2025, by which, he sought transfer of the E-Khatha of the subject property to his name.

(i) The petitioner claims that property bearing

Kaneshumari No.11 situate at Seethakempanahalli village, Hesaraghatta Hobli, Bengaluru North Taluk was owned and possessed by Smt.Bachamma and after her death, it stood transferred to her son Sri. Munianjanappa. The said Sri. Munianjanappa died on 01.09.2014 leaving behind his wife Smt.Gowramma and children. After the death of Sri. Munianajanappa, Smt.Gowramma submitted a representation before the Panchayat Development Officer, Shivkote Village Panchayat to transfer the Khata of the aforesaid property to her name. Accordingly, the Khata was

transferred to her name. Subsequently, Smt. Gowramma and other legal representatives of Sri. Munianjanappa, executed a release deed dated 14.11.2022 in favour of the petitioner releasing their rights in respect of the aforesaid property. The petitioner thereafter submitted a representation dated 15.11.2022 before the respondent No.1 requesting him to change the Khata of the property to his name.

(ii) Thereafter a survey was conducted and an E- property sketch was prepared for the purpose of effecting the mutation. However, no further action was taken by respondent No.1. Therefore, the petitioner made several representations including an application requesting the authorities to issue E- Khata in his favour. However, respondents failed to take any action. Therefore, the petitioner is before this Court seeking for a direction to the respondents to consider his representations to transfer the Khata of the aforesaid property to his name.

The learned counsel for the petitioner reiterated the above contentions and submits that even after 03 years from the date of preparing the E-sketch, the respondents have not

taken any action to transfer the Khata. He therefore, prays a direction be issued to the respondents to consider the representation submitted by petitioner and transfer the Khata of the aforesaid property in his name.

The learned counsel for respondent Nos.1 and 2 submits that steps would be taken to consider the representations and if the request of the petitioner is in order, steps would be taken to issue E-Khata in accordance with law.

In view of the aforesaid submission, this writ petition is disposed off directing the respondents to consider the representations of the petitioner dated 15.11.2022 and 03.07.2025 and if documents produced by the petitioner is in order, shall effect the Khata of the aforesaid property in the name of the petitioner. This shall be complied within a period of 08 weeks from the date of receipt of a copy of this order.
